Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Earth Tab platform and its applications (the “Service”), provided by Earth Tab LLC (doing business as “Earth Tab,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 16 years old and authorized to act on behalf of your business or Organization to use the Service. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.

2. The Service

Earth Tab provides business management tools, including inventory management, vendor ordering, invoice and email processing, notifications, and analytics. Features available to you may depend on your Organization’s subscription plan and configuration. We may add, change, or remove features over time.

3. Google Account & Gmail Access

If you connect a Google account or enable email scanning, you authorize Earth Tab to access certain Google data (such as your profile and Gmail invoice/order emails) to provide the features you request. Our use of Google user data is described in our Privacy Policy and adheres to the Google API Services User Data Policy, including the Limited Use requirements. You may revoke access at any time through your Google account permissions.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, copy, or resell the Service except as permitted by law.
• Upload content you do not have the right to use, or that infringes others’ rights.

5. Your Data

You and your Organization retain ownership of the business data you submit to the Service. You grant Earth Tab a limited license to host, process, and use that data solely to provide and improve the Service, as described in our Privacy Policy. You are responsible for ensuring you have the rights to provide any data you submit.

6. Subscriptions, Auto-Renewal & Cancellation

Paid plans are billed on a recurring subscription basis (for example, monthly) at the price and per-store quantity shown at sign-up. Your subscription automatically renews at the end of each billing period, and your payment method is charged the then-current fee for the next period until you cancel.

If your plan includes a free trial, we will not charge you during the trial. Unless you cancel before the trial ends, your subscription converts to a paid subscription and your payment method is automatically charged the recurring fee when the trial ends.

You can cancel at any time from your account billing settings or by emailing support@earthtab.com. Cancellation stops future renewals and takes effect at the end of your current billing period; you keep access until then. Fees already charged are non-refundable except where required by law. We will give reasonable advance notice of any price change, which applies to your next renewal.

7. Third-Party Services

The Service integrates with third-party services (such as Google, email providers, and AI processing services). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.

8. Service Availability

We strive to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may suspend or limit access for maintenance, security, or to address violations of these Terms.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, Earth Tab and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business, arising out of or related to your use of the Service.

11. Termination

You or your Organization may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, certain provisions of these Terms will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state and federal courts located in California, and you consent to their jurisdiction, except where applicable law provides otherwise.
